PLAINTIFF WIN AGAINST BOSTON POLICE

On October 3, 2014 , a federal jury awarded our client, Scott Matalon, the sum of $50,000.00 against Boston Police Sergeant Mary Ann O’Neil and Officer Joseph Hynes. Mr. Matalon had been asleep in his home when O’Neil ordered police to rush into his home with a dog and a gun, looking for a suspect who had allegedly robbed a restaurant several blocks away. The jury found there was no probable cause to enter our client’s home.

The client became angry and was arrested for allegedly assaulting one of the cops.  A jury in criminal court had previously found him NOT GUILTY before we filed his federal claim.

Friday’s jury also found that Officer Joseph Hynes utilized excessive force in making the arrest.

A victory in such a case allows the client to petition for attorney’s fees above and beyond the jury verdict. We anticipate the total award to be over one hundred thousand dollars.  STAY TUNED.
